1) For any Advanced tests, where the client has to arrange a local phlebotomist for sample collection or whether the client himself/herself has to collect the sample, iThrive shall in no manner, whatsoever and howsoever, be responsible for any physical/mental/monetary loss, damage, delay or inconvenience to any person including the client, whether or not the appropriate process of sample collection as per iThrive’s instructions is followed by the Phlebotomist / the client, which thereby might result in sample rejection by the Diagnostic lab.
2) While iThrive, in its sole discretion, may provide some assistance for documentation (format) for Fedex logistics and shipping of the test sample(s), it shall be the sole responsibility of the client to arrange for Fedex or any other logistic services to ship the sample (s) to the desired Diagnostic Lab. iThrive shall not be responsible in any manner, whatsoever and howsoever, for any delay in shipping the sample or any consequential physical / mental / monetary loss or damage, which the client may have to incur.
3) The client clearly understands that iThrive is a third party facilitator which just assists the clients with booking of the Advanced tests and arranging for test kits and sharing sample collection instructions, process and other advanced test guidelines and relevant documents, where required. iThrive shall not be responsible in any manner whatsoever and howsoever, physical / mental / monetary loss, damage, delay or inconvenience to any person including the client, arising out of any acts or omissions of the client, the Diagnostic lab, the Logistics / shipping service provider, the sample collection person - Phlebotomist or any other person, except iThrive, involved in the process cycle of Advanced test
4) For Advanced tests, where details are to be filled in by the client or to be provided by the client to iThrive for filling in / registration, the client hereby agrees to ensure that such information will be true and correct and the client shall be solely responsible any consequential physical / mental / monetary loss, damage, delay or inconvenience resulting from any misinformation / incorrect information filled in by the client or provided to iThrive by the client in relation to such Advanced Tests
5) The client also understands that once the sample collection kit reaches the client, the client shall solely be responsible for any breakage, damage to such Kit and the client shall bear all related costs thereto. iThrive shall in no manner, whatsoever and howsoever, be responsible for any physical / mental / monetary loss, damage, delay or inconvenience to any person including the client, due to such breakage or damage.
6) The client hereby agrees and understands that any refund, due to any cancellation of the test or otherwise, shall be as per iThrive’s refund policy and subject to deductions of any expenses incurred therefor by iThrive, provided further that such refund shall only be made if the Diagnostic Lab provides such refund.
7) The client understands that iThrive shall in no manner be responsible for any losses, damages, or inconvenience to the client due to delay in receiving the sample collection Kits, sample rejection or wrong reporting by the Diagnostic Lab and the client shall keep iThrive indemnified in that regard.
8) The client understands that for certain advanced tests the client has to be first registered on the Diagnostic Lab portal before the sample is sent otherwise the sample might be rejected and iThrive shall not be responsible for such rejection and any consequential loss, damage, delay or inconvenience for which the client shall be solely responsible.
9) The Client also understands that the client needs to sign the consent form where required otherwise the shipped sample may be rejected and iThrive shall not be responsible for such rejection and any consequential loss, damage, delay or inconvenience for which the client shall be solely responsible.
10) In Spite of all of the above, in case of sample rejection, wrong reporting, refund and any other issues , iThrive shall make all endeavors to provide the needed support to help resolve any such issues.
